3. DATA WE COLLECT

To provide our services and operate effectively, we collect different types of personal data. We only collect data that is relevant, proportionate, and necessary for our purposes.

Information You Voluntarily Provide

When you interact with us — for example, by filling out a form, subscribing to updates, or becoming a client — you may share:

  • Basic identification details: such as your name, job title, and company name.

  • Contact details: including your email address, phone number, and professional address.
  • Billing and transaction data: like invoice details or payment method, processed securely through trusted third-party payment providers.

  • Testimonial content: if you choose to leave feedback, we may display your name, business name, photo, or logo — only with your permission.

  • Account-related data: if you access a client portal, we may collect login credentials and associated account info.

Data Collected Automatically

When you browse our site or use our services, certain technical data may be collected automatically to help us understand usage patterns and improve the experience:

  • IP address and device information

  • Browser type, version, and language

  • Operating system

  • Pages visited, referring/exit pages, and time spent on site

  • Device type and general location (e.g., region or city, when enabled)

We also use cookies and similar technologies to support functionality, analytics, and (where applicable) marketing — always in line with consent requirements under CNIL and GDPR. You can manage these preferences at any time.

Email Marketing and Location-Based Data Processing

We send email content such as newsletters, service updates, and relevant promotional messages to our subscribers. To comply with international privacy laws, especially the GDPR, we segment our email list based on user location (EU/EEA/UK vs. non-EU).

  • Location Selection: When subscribing, users are asked to indicate whether they are located inside or outside the EU/EEA/UK. This allows us to apply the appropriate data protection standards.

  • Tracking Preferences: For subscribers located outside the EU/EEA/UK, we may use email tracking tools (e.g., open and click tracking) in line with more flexible legal frameworks. For EU/EEA/UK residents, we apply GDPR-compliant practices and may limit certain tracking features unless explicit consent is provided.

Subscriber Responsibility for Data Accuracy:

We rely on the information provided by our subscribers to maintain accurate records. If you relocate to a different jurisdiction, such as moving into or out of the EU/EEA/UK, please update your location preferences through our email preference center (a link is included at the bottom of each email). This helps ensure that we process your data in accordance with the applicable legal framework.

This approach helps us protect your privacy and reduce unnecessary data exposure.

5. DATA RETENTION

Laurence Zimmermann EI, FractalMax retains personal data only for as long as necessary to fulfill the purposes for which it was collected, to comply with legal and regulatory obligations, or to resolve potential disputes. We follow the principle of data minimization and storage limitation in accordance with Article 5(1)(e) of the General Data Protection Regulation (GDPR) and CNIL guidelines.

At the end of the applicable retention period, data will be securely deleted, anonymized, or archived where required for specific legal or compliance purposes.

Retention Periods by Processing Purpose

Website Design Services

Personal data related to web design projects is retained for up to 1 year after the project has been completed, unless further retention is required for legal or contractual follow-up.

Public Relations Services

Personal data related to PR services is retained for up to 1 year after the project has been completed. If the press release remains publicly accessible or relevant to legal obligations, data may be archived beyond this period solely for documentation purposes.

Client Portal Access

  • After service completion, access to the private portal is retained for 3 months to allow the client to download any shared materials.

  • If collaboration is ongoing or reasonably expected to resume, data may be retained for up to 1 year to ease reactivation.

  • After this period, all portal-related data will be securely deleted unless required by law or preserved with the client’s consent.

  • If the portal has been deleted, a new one will be created for future services.

Email Marketing

Personal data used for email communications and marketing is retained for up to 3 years from the last interaction or until you withdraw consent, whichever comes first.

Invoices containing personal data are retained for at least 10 years to comply with French tax and accounting regulations. After this period, the data is securely archived and restricted from active use.

When explicit consent is given for the use of a testimonial, the duration of use is not predefined. However, the right to withdraw consent may be exercised at any time in accordance with the GDPR.

Consent for International Transfers of Data

Consent related to data transfers outside the European Economic Area (EEA)—such as for publication on international PR platforms—is retained for 5 years from the date of publication. If the content remains publicly accessible or relevant to legal obligations, data may be archived for longer, solely for documentation purposes and without further use.

Third-Party Authorization Forms

Consent obtained via third-party forms is also retained for 5 years from the press release publication date, with similar provisions for legal archiving if needed.

Deletion or Anonymization

At the end of the applicable retention period, all personal data will be either securely deleted or anonymized in order to prevent any identification of the individual.

However, exceptions apply to specific data categories—such as invoices or legally required records—which must be retained to comply with legal or regulatory obligations. In such cases, the data will be securely archived, access-limited, and excluded from any active processing, ensuring it is not used for any purpose other than compliance.

7. SHARING PERSONAL DATA

Laurence Zimmermann EI, FractalMax only shares your personal data with third parties when it is strictly necessary for the provision of our services, to meet legal obligations, or to improve and personalize your experience.

Categories of Recipients

Your data may be shared with the following categories of recipients:

  • Hosting Providers: For secure hosting of our website, client portals, and related services.

  • Payment Processors: To handle secure processing of payments and refunds.

  • Email Marketing Services: To send newsletters, updates, or promotional content — only with your explicit consent.

  • Analytics Providers: To analyze website performance and visitor behavior (e.g., Google Analytics, with IP anonymization).

  • Communication Tools: To enable customer support via live chat, email, or video calls.

  • Advertising and Retargeting Partners: To display relevant ads based on your consented preferences (e.g., marketing cookies).

  • Marketing Automation Platforms: To manage email campaigns, CRM systems, social media scheduling tools, and other promotional processes.

All third-party service providers are contractually bound to respect the confidentiality and security of your personal data and are only authorized to process it on our behalf and according to our instructions.

International Data Transfers

In certain cases, your personal data may be transferred outside the European Economic Area (EEA), including to countries that may not offer an equivalent level of data protection (e.g., the United States). When such transfers occur, Laurence Zimmermann EI, FractalMax implements appropriate safeguards to ensure compliance with the General Data Protection Regulation (GDPR).

These safeguards may include:

  • Standard Contractual Clauses (SCCs): We use the European Commission’s approved SCCs when transferring data to providers in non-adequate countries. These clauses ensure that the recipient guarantees a GDPR-compliant level of data protection.

  • Supplementary Measures: Where necessary, we implement technical and organizational measures such as encryption or pseudonymization to strengthen data protection.

  • EU-U.S. Data Privacy Framework: When transferring data to the United States, we verify whether the recipient is certified under the EU-U.S. Data Privacy Framework, which provides an approved mechanism for lawful data transfer. You can check the official list of certified companies at: https://www.dataprivacyframework.gov.

All international transfers are carried out with due diligence and legal compliance, ensuring that your data remains protected regardless of geographic location.

International Transfers and PR Services

Laurence Zimmermann EI, FractalMax Agency, utilizes a third-party platform for press release distribution. Currently, this platform does not have a Data Processing Agreement (DPA) in place.

In accordance with guidance from the French Data Protection Authority (CNIL), which specifies that regular or systematic international transfers must not rely solely on the derogation of explicit consent, we have made the decision to restrict access to our PR services to users located outside the EU and UK until a suitable DPA is in place or an adequate safeguard is available.

Please note that journalists and media outlets act as independent recipients and are not under our control. Once a press release is publicly distributed, we cannot monitor or influence how the information is used or processed by these independent entities.

Targeted Media Outreach and International Distribution
At the client’s request, Laurence Zimmermann EI, FractalMax may distribute client-approved press releases to international journalists, publishers, podcast hosts, content platforms, and other independent media contacts, including those located outside the European Union (EU), European Economic Area (EEA), or United Kingdom (UK). These recipients act as independent data controllers and are not under our control. Once information is shared or published for media purposes, its further use falls under the recipient’s own editorial responsibility.

To fulfill this service, we may transfer personal data—such as your name, email, company name and address, biography, photo, and other relevant information—outside the EEA. These data transfers are made for the intended purpose of public disclosure through media outreach or public relations campaigns.

Because some of the countries where these recipients operate may not offer an equivalent level of data protection as under EU law, we rely on your explicit and informed consent before initiating any such outreach. This consent is collected via a clearly presented, unticked checkbox, and is required before any personal data is shared with third parties outside the EEA.

By checking this box, you confirm that you understand and accept that your personal data may be shared with third-party media contacts outside the EEA for the purpose of public communication, and that local laws in those countries may not offer the same level of protection as GDPR.

Your consent is documented and retained for compliance purposes. You may withdraw your consent at any time by contacting us at info@fractalmax.agency; however, withdrawal does not apply retroactively to data already shared or content already published.

Laurence Zimmermann EI, FractalMax does not share personal data unrelated to the press release content unless explicitly authorized by the client.

Consent and Data Transfers Outside the EEA

Explicit Consent and Retention

Transfers of personal data outside the European Economic Area (EEA) may occur occasionally in connection with certain tools or services used for delivering projects (e.g., website hosting, contact forms, or automation tools). These transfers are never performed on a regular or systematic basis, in accordance with Article 49(1)(a) of the GDPR and the guidance of the French Data Protection Authority (CNIL).

Where required, explicit and informed consent will be obtained from the data subject prior to any such transfer. This consent will be documented and retained for five (5) years or as long as legally necessary. After this period, the data will be archived and restricted from active processing.

Validity Period of Consent

The validity of consent is limited to twelve (12) months from the date of signature. After this period, new consent is required before any further transfers take place.

Data Minimization Principle

We adhere to the principle of data minimization, collecting and processing only the data necessary for the specified purpose, such as press release distribution or website hosting. This aligns with Article 5(1)(c) of the GDPR, which mandates that personal data be "adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed.

Withdrawal of Consent

In accordance with Article 7(3) of the GDPR, individuals have the right to withdraw their consent for the processing or transfer of their personal data at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

Press Releases

Due to the public and irreversible nature of press release distribution, withdrawal of consent is subject to the following legal limitations, as outlined in Article 17(3)(a) of the GDPR:

  • No Retroactive Effect: Withdrawal of consent does not apply to press releases that have already been published or distributed to third parties such as journalists, media outlets, or public platforms. These are protected under GDPR provisions safeguarding freedom of expression and information.

  • Archived Copies: Withdrawal of consent will not result in the removal of content from media archives or platforms not under our control. This exception is recognized by the GDPR to preserve the public record and editorial independence.

  • No Further Use: Once consent is withdrawn, the individual's personal data will not be included in future press releases, processed for new purposes, or shared with additional third parties.

Web Design and Other Services

For services like web design or digital implementation:

  • Website Hosting: Personal data may be transferred outside the EEA if hosting servers are located in non-EEA countries.

  • Use of Third-Party Tools: Certain necessary tools (e.g., form builders, analytics, payment processors) may involve data transfers outside the EEA. These are selected carefully and evaluated for compliance.

Client Rights

Clients may withdraw their consent for international data transfers at any time. We will process such requests within seven (7) business days.

  • This does not result in the termination of the service agreement and does not entitle the client to a refund.

  • Essential personal data needed for contract execution or legal compliance will continue to be processed.

  • Non-essential personal data will be deleted or anonymized upon request, unless legal retention obligations apply.

If you have concerns regarding the security of your personal data or suspect a potential breach, please contact us without delay at: info@fractalmax.agency

9. USER RIGHTS

As a user of Laurence Zimmermann EI, FractalMax’s services, you have important rights concerning how your personal data is handled. These rights are granted under the General Data Protection Regulation (GDPR) and the French Data Protection Act (Loi Informatique et Libertés), and we’re committed to helping you exercise them with transparency and respect.

Your Legal Rights Include:

Access to Your Data

You may request confirmation of whether we hold personal data about you and, if so, receive a copy of the data and information on how it’s being used.

Correction of Inaccurate Data

If any of your personal details are incorrect or incomplete, you can ask us to update or complete them.

Right to Erasure

In certain situations, you can request that we delete your personal data — for example, when the data is no longer needed or if you withdraw previously given consent. Please note that in some cases (e.g., accounting records), we may be legally required to retain the data for a set period (such as 10 years under French law).

Restriction of Processing

You have the right to request limited use of your data — for instance, while we verify its accuracy or in the case of a pending objection.

Data Portability

You can request your data in a structured, commonly used format, and ask that we transfer it to another organization if technically possible.

Objecting to Use of Data

You may object to certain uses of your data, including for direct marketing. When you object, we will stop processing unless we have compelling legitimate grounds to continue.

Withdraw Your Consent

If we process your data based on consent, you can withdraw that consent at any time. This won’t affect the lawfulness of any data use before the withdrawal.

Lodge a Complaint

You have the right to file a complaint with your local data protection authority. In France, this is the CNIL (Commission Nationale de l’Informatique et des Libertés).

Exercising Your Rights

To make a data-related request or exercise any of your rights listed above, you can contact us directly:

Email: info@fractalmax.agency

Mail: Laurence Zimmermann EI, FractalMax

  • Adequacy decisions, where applicable.

When Explicit Consent May Be Required

In rare cases where a provider does not have a Data Processing Agreement (DPA) in place and operates from a country without GDPR-level protection, we may ask for your explicit consent before transferring any personal data. You will be informed of the intended purpose and any potential risks beforehand.

We share only the minimum necessary data and ensure third parties act in accordance with this privacy policy.

Important Clarification Regarding PR Services

Due to the absence of a DPA with the platform used for press release distribution and in line with French and EU data protection laws, our PR packages are not sold to users located in the EU or UK. This measure is in place to ensure full compliance with CNIL and GDPR guidance.
