Pilot Targeted Media Outreach Campaign Terms of Use

By participating in the Laurence Zimmermann EI, FractalMax Pilot Outreach Campaign, you agree to be bound by these terms, which govern your participation in the campaign. These terms are supplementary to the General Terms of Use and the Privacy Policy, which also apply to all interactions with our services. Please read these terms carefully.
1. Purpose
The Pilot Outreach Campaign is a free initiative provided by Laurence Zimmermann EI, FractalMax, to:

Connect participating businesses with relevant journalists, bloggers, or influencers.

Demonstrate the value of our media outreach services.

Gather feedback and testimonials to refine and improve our offerings.
2. Eligibility
To participate in the Pilot Outreach Campaign, you must:

Have a registered business or be authorized to act on behalf of a registered business.

Countries allowed for participation will be specified in the registration form.

Accepted topics and industries will be specified in the registration form.

Read and accept the publishing guidelines.

Confirm eligibility by checking the appropriate box on the registration form.

Final decisions on the acceptance of applications rest solely with Laurence Zimmermann EI, FractalMax, which reserves the right to approve or decline applications at its discretion.
This offer is exclusively for businesses that are not already PR customers of Laurence Zimmermann EI, FractalMax.
Participation is limited to 20 businesses and is granted on a first-come, first-served basis or through direct outreach by Laurence Zimmermann EI, FractalMax to relevant businesses.
3. Scope
Laurence Zimmermann EI, FractalMax reserves the right to define the start date of the service, which may not be immediate depending on the workload at the time of registration. Participants will be notified of the start date within a reasonable timeframe after registration.
The pilot campaign will be executed within a timeframe of 4 weeks from the start date. In cases where additional time is required due to the scope of outreach or unforeseen circumstances, the timeframe may be extended to ensure the campaign's success. Participants will be notified of any adjustments to the schedule.
The pilot campaign provides a simplified version of our media outreach services, which includes:

Outreach to up to 15 journalists, bloggers, podcasts, or influencers, tailored to a single niche or industry specified by the participant.

Basic review and SEO optimization of a press release provided by the client, or creation of an AI-generated press release (up to 400 words) upon client approval.

Clients opting for an AI-generated press release must review and explicitly approve the content before it is used for outreach.

General pitch templates without advanced customization.
-
Up to 2 follow-up and basic feedback.
The pilot is intended to provide an introduction to our services and does not replicate the full scope of our paid campaigns.
Start date: The pilot campaign will officially start once the participant has either:

Reviewed and approved the AI-generated press release provided as part of the service, or
-
Submitted their own press release for review and basic optimization.

Outreach activities will begin only after the press release has been finalized.
Participant Responsibilities
Participants are responsible for providing accurate and timely information required for the outreach campaign, such as target audience details, relevant materials (e.g., press release content), and any specific preferences. Failure to provide this information may delay or limit the effectiveness of the campaign.
4. Private Portal Access

Businesses accepted into the pilot offer will gain access to the FractalMax Private Portal.

The Private Portal will serve as the primary platform for communication between participants and Laurence Zimmermann EI, FractalMax.

Updates, feedback, and all necessary details regarding the campaign will be shared through the portal.

Participants will also have access to PR guides through the FractalMax Private Portal to help them better understand media outreach and optimize their campaign outcomes.

Participants are expected to regularly check the portal to stay informed about their campaign progress.
5. Free Offer with No Obligations
Participation in the Pilot Outreach Campaign is entirely free and carries no obligation to purchase additional services or enter into a paid agreement.
6. Intellectual Property

Participants retain full ownership of all intellectual property (e.g., logos, press release content, and other materials) shared with Laurence Zimmermann EI, FractalMax for the purposes of the pilot campaign.

By participating, participants grant Laurence Zimmermann EI, FractalMax a temporary, non-exclusive license to use these materials solely for executing the pilot campaign, including outreach activities.
Third-Party Use of Materials

Participants acknowledge that materials provided for the campaign (e.g., press releases, logos) may be shared with third parties, such as journalists, bloggers, influencers, or podcast hosts, for outreach purposes.

These third parties may choose to use the materials for publication, distribution, or promotional purposes at their discretion.

Laurence Zimmermann EI, FractalMax, does not control or assume responsibility for how third parties use these materials.
7. Logo Authorization
By participating in the campaign, you agree to:

Allow Laurence Zimmermann EI, FractalMax to display your company logo in the "Brands We've Worked With" section of our website or marketing materials. This section may alternatively be titled "Businesses We've Worked With," "Entrepreneurs We've Worked With," or a similar title.

This authorization is non-exclusive and can be revoked at any time upon written request.

Upon revocation, Laurence Zimmermann EI, FractalMax, will remove the logo within 7 business days.
8. Testimonials
At the end of the campaign, we will invite you to provide feedback or testimonials (written or video). While your input would greatly help us refine our services, providing a testimonial is entirely voluntary and at your discretion.
If provided, testimonials may be used by Laurence Zimmermann EI, FractalMax, on our website, social media platforms, marketing materials, or other promotional supports.
9. Limitation of Liability

Laurence Zimmermann EI, FractalMax, will make reasonable efforts to execute the pilot campaign effectively; however, specific outcomes, such as media coverage, influencer engagement, or features by journalists, bloggers, influencers, or podcasts, cannot be guaranteed. These decisions are entirely at the discretion of third parties.

Participation in the campaign does not establish a contractual relationship or partnership beyond the scope of this pilot initiative.

Laurence Zimmermann EI, FractalMax, is not responsible for any indirect, incidental, or consequential damages arising from participation in the campaign.

Laurence Zimmermann EI, FractalMax, reserves the right to terminate or modify the campaign due to unforeseen circumstances, such as technical issues, changes in business operations, or events of force majeure.

Laurence Zimmermann EI, FractalMax, reserves the right to postpone or reschedule the campaign if unforeseen circumstances, such as illness (e.g., the flu) or other personal incapacity, prevent the campaign from being executed as planned. Participants will be notified promptly, and efforts will be made to reschedule within a reasonable timeframe.

While Laurence Zimmermann EI, FractalMax, will perform outreach as outlined, the company is not responsible for the actions, decisions, or responses of third parties contacted during the campaign.

Participants agree to hold Laurence Zimmermann EI, FractalMax, harmless from any claims, liabilities, or disputes arising directly or indirectly from their participation in the campaign.
10. Fair Use and Participant Conduct
Prohibited Behavior
Participants agree to use the Pilot Outreach Campaign services in good faith and solely for their intended purposes. The following actions are prohibited:

Providing false or misleading information.

Using campaign materials (e.g., outreach templates) for unrelated purposes without written consent.
Confidentiality
Participants agree not to share access to the FractalMax Private Portal or its resources with others without prior written consent. If access is required for a team member, participants may request approval from Laurence Zimmermann EI, FractalMax.
This obligation does not apply to materials provided by the participant themselves (e.g., press releases or submitted content).
Right to Terminate
Laurence Zimmermann EI, FractalMax reserves the right to end participation in the pilot campaign if a participant violates the terms of this agreement, disrupts the campaign, or uses it in a way that conflicts with its intended purpose.
Use of Services
The pilot campaign is provided free of charge to showcase the services of Laurence Zimmermann EI, FractalMax. Participants are expected to use the campaign for its intended purpose of improving visibility through media outreach. Any misuse that compromises the integrity of the campaign may result in termination of participation.
11. Data Usage
Any data collected during the registration and participation process will be handled in accordance with GDPR and used solely for the execution and improvement of the campaign. For further details, refer to our Privacy Policy.
12. Follow-Up Offers
Upon completion of the pilot, participants may receive information about our paid PR services. There is no obligation to upgrade or purchase any additional services (now or in the future).
Participants are free to unsubscribe from email communications at any time using the link provided at the bottom of our emails.
13. Severability Clause
If any provision of these terms is deemed invalid, unenforceable, or contrary to applicable laws by a competent court or authority, the remaining provisions shall continue to be fully valid and enforceable to the extent permitted by law.
14. Applicable Law and Jurisdiction
This agreement is governed by French law. Any disputes arising from the pilot campaign will be subject to the exclusive jurisdiction of the courts in Paris, France.
15. Acknowledgment
By participating in the Laurence Zimmermann EI, FractalMax Pilot Outreach Campaign, participants confirm that they have read, understood, and agreed to the specific terms outlined above. Participants also agree to be bound by the General Terms of Use and the Privacy Policy, which govern all interactions with Laurence Zimmermann EI, FractalMax’s services.
